By successfully clicking through using an "I agree" button on our website or by continuing to access our Systems, you agree unconditionally to the following:
  1. About Our Website Content:
    1. General. While we try to keep our website as online, updated, correct and free of malicious elements as possible, it may not always be. We remind and encourage you to exercise your responsibilty for patching and updating your software, especially your Operating System, browsers & antivirus program. Furthermore, should our Systems ever be compromised, please do not interact with them except to inform us of the breach.
    2. TOU Changes. At our sole discretion and without notifying you, we may add, delete or change any of the clauses in this agreement, our privacy policy or our bookings terms & conditions. We will indicate a material change by changing the relevant agreement version number and date. You are responsible for checking for updated terms and choosing whether to accept them.
    3. Intellectual Property Ownership. To the best of our knowledge, the design & content (eg. trademarks, text, markup, multimedia) of this website are either property of Ms Jacqueline Choo, validly licensed or are fair dealings with 3rd Party intellectual property. If you believe your work has been misappropriated or misused, please contact us detailing the issue. We'd really like to save you the trouble of running screaming to your lawyer demanding our head on a platter, julienned.
    4. 3P Websites. Under normal circumstances, if the context doesn't already make it clear, hyperlinks to 3rd Party Websites will have this icon to their right. We provide such links for your convenience, and because we believe the links do not offend their Website Terms of Use. We do not endorse, warrant the correctness of nor have control over the content and policies of 3rd Party Websites. Hence, you will have to review their data, data protection and privacy policies yourself. We do not endorse, nor are endorsed by the 3rd Parties we hyperlink to. With the exception of Sanubari Beach Resort, neither are we commercially associated with any hyperlinked 3rd Parties.
  2. You will exercise Your Responsibilities to:

      • Server Interactions. Apart from emailing us, you may access only "publicly available files" for reasonable amounts of personal viewing, and ONLY through the html (whether php-generated or not) user interfaces we provide; all other behavior is unauthorised.
      • For the enjoyment of all users, we appreciate that you promise not to compromise the integrity, security, efficiency, reasonable response times and functioning of our content, servers and server connections. In particular, You MAY NOT: access; intercept; hijack; record; circumvent; spoof; deny or impede authorised access to; make available or facilitate unauthorised access to; sell; rent; distribute; or alter
        • any data on, or
        • any security mechanism in place (whether server or client-side) that controls access to or use of data on, or
        • any connections or communications to or from
      • our servers or in our databases that you are not authorised to.
    2. responsibly link & present. We totally encourage hyperlinks to our website; there really wouldn't be a point to being on the Web otherwise. However, we also ask that you:
      1. do not hotlink. You should not create, mantain or distribute direct links to any non-html content on our site. Doing so is often frowned upon as "bandwidth theft" because the linker is (sometimes unknowingly) freeriding on the content owner's bandwidth.
      2. present our website and business in a fair manner. This includes:
        1. not expressing or implying association or endorsement where none exists. For example, you must not place our website content in

          that are ambiguous or misleading as to origin.
        2. not presenting us in an awkward nor potentially disturbing light. For example, on the off-chance you own an adult-content or other controversial (by conservative standards) website, even if you really like the content on our website, we'd appreciate it if you did not link us on your business website. We'll probably look at it differently if you rave on your personal blog.
        3. not defaming us. For clarity, a scathing commentary (substantiated by fact) on our services is not defamation. We would, however, regard a systematic sending of junk or unsolicited commercial (e)mail using our name as.
    3. appropriately & fairly use content & services.
      1. Respect our Copyright. Fair dealing for private study/research, criticism and journalism generally requires you limit the percentage of our content reproduced to under 10%. You may also keep one copy of all photographical "publicly available files" provided that copy is for your sole, private, non-commercial use and not distributed, publicly performed, altered or used to create derivative works in any way. However, if the content involves the likeness of a recognisable person, you may keep that one copy ONLY IF you have the informed consent of the person photographed. For clarity, i) this "one copy" license is non-transferable & non-exclusive, and ii) images (or any other "publicly available files") pulled off our servers for use in temporary browser caches don't count as "one copy".
      2. Respect our subjects. Thou shalt not pester/social-engineer/lie to for permission. No means no.
      3. Speak freely, but responsibly. Some parts of the site allow picture ratings & comments. If you leave a comment, by all means say how the technical aspects & aesthetics suck and, preferably, also how they can be improved. But please lay off any personal attacks and defamatory or unkind remarks, especially about the subject. You shouldn't be using our website for spam advertising campaigns either. If we chance upon inappropriate material we will remove it.
      4. Respect our trademarks, servicemarks and other Goodwill. For example, if you participate in a keyword-based advertising program, you may not use our trademarks, servicemarks or other relatively unique data (especially in our metatags) as keywords.
    4. be cautious when dealing with financial information and requests. Please do not respond to any emails purporting to obtain 'hidden' payment fees ever. Don't give out your bank account details or other sensitive financial information either, unless you have initiated a wire transfer request, instead of using the escrow-ish eNets or paypal options. If you suspect something isn't right, please let us know.
    5. be security-conscious. Although we do have some security measures in place, they are no where as snazzy/competent as what you'd get from a bank. So if you register with our website to access restricted areas, please bear in mind the following:
      1. DO NOT use the same username or passwords that you use for accessing important & sensitive information elsewhere, such as with Paypal, your online banking portal or even your primary email account.
      2. Choose passphrases over passwords. A passphrase is just a series of words, a sentence even. If possible, use a combination of upper and lowercase alphabets, numbers and special characters in your passphrase or password. If you use a password, use one that isn't a valid word in a language (english, hanyu pinyin, malay, romanised tamil etc), or a common variation on one, eg. a noun spelt backwards.
      3. Don't pick an overly simple or easily guessable password such as your ic number, spouse's name, child's birthdate, parent's birth year etc.
      4. Try not to pick short passwords. Try to make it at least 8 characters long. If you forget your password, you can get it reset. Do remember to delete that password reset/recovery email when you are done.
      5. Safer Storage. If you really must write down your passphrase/word, keep your piece of paper in a relatively private area, such as in your wallet. And no, under your keyboard and the side of your monitor aren't the safest places in the world. Also, don't help a snooper out, if possible, keep your userids, passwords & relevant websites seperate.
    6. responsibly disclose information. If you notice a security flaw, a bug we've failed to patch, or other heinous workflow transgression, please let us know before broadcasting that information to others. Email us the full details please. We'd appreciate it if you include 'snafu' in the subject line, and if possible, the URI of the relevant security advisory or bug documentation. Holes are definitely something we'd want plugged.   3. General
    1. Interpretation.
      1. This contract must be given the widest interpretation possible, and where not unreasonable, to our benefit. For example, clause headers, lead-in text and examples are not meant to be restrictive nor conclusive of intention; They are indicative only.
      2. Visual Formatting. The rendering of this agreement in Firefox.1.5.0.4 is authoritative.
      3. Conjunction. Clauses, sub-clauses and their sub-parts are to be read conjunctively unless indicated otherwise.
      4. Severability. The words and clauses in this agreement are severable. This means an arbitrator or a competent court of law may strike out and, if applicable, replace the offending portion with words & punctuation that most closely represents the commercial intention of the parties.
      5. Important words - Logic Qualifiers - Definitions
        1. "include/s", "such as", "for example": Such phrases are followed by a non-exhaustive definition or listing of objects/concepts. Also, the Ejusdem Generis principle, and similar, shall not apply. For practical purposes, this means the relevant class of objects/concepts associated with such lists shall be interpreted as abstractly as possible, to the point just before the abstraction gets absurd. An example of absurdity: an exhaustive list being qualified by an non-exhaustive list to the extent the former is negated.
        2. "mean/s": is followed by an exhaustive definition or listing of examples.
      6. Important words - Nouns & Verbs -Definitions
        1. "You" - means you, the natural person(ie. human) accessing this website.
        2. "We", "Our", "Us" - refers to the owner of 'Invertigo Studios' (Business Reg No: 53041113W), currently, Ms.Jacqueline Choo. In the context of electronic communications, "us" means our servers.
        3. "this website" - means all documents and data we intend to be accessed by the public through, and only through the http protocol via the domain name "invertigo-studios.com".
        4. "access" includes all direct and indirect forms of access, whether human or computer assisted. Direct access occurs when you control in real-time the actions of a user-agent (eg. a browser). Indirect forms of access include other humans and automated user-agents such as spiders and website download managers.
        5. "personal private information" means information that is ordinarily private and can most likely be used to, directly & successfully, personally identify or masquerade as you. It includes your email address, your Identification Document numbers, your financial details and contact numbers. It does not include 'traffic data'.
        6. "publicly available files" means the html(including those generated by php scripts, but not the scripts themselves) and graphic files accessible through the index.html & index.php interfaces provided on our webserver, configured to not require user authentication.
        7. "Systems" means the totality of all computers & electronics used by employees or contract workers of Invertigo Studios and the firmware, software, & data on all such hardware.
        8. "traffic data" means the data involved in transmitting information to and from you over communication networks. It includes technical information such as your browser type & version, your ip addresses and your interactions with our servers.
    2. Limits of Legal Relationships formed: Indemnities, Warranties, Obligations & Waivers
      1. In general, No Warranties. This website is a free service we provide "AS-IS" and "AS-AVAILABLE". For the full extent allowed for by law:
        1. All responsibilities, liabilities, warranties and representations for all content and services provided, whether express, implied or statutory, are disclaimed. These include "fitness of purpose", "title", "legality", "completeness", "integrity", "correctness", "reliability", "timeliness", "availability", "malware-free or error-free operation and transfer" of information and services to and from our Systems.
        2. Because this website is provided "as-is" and "as-available", you agree you have no right of access to this website or our servers' other functions. Hence, if there is no malice or mischief on the part of Invertigo Studios' workforce, you agree you cannot receive compensation for distress, inconvenience or loss: real, economic, emotional or otherwise, however-stemming from our website, servers, Systems or their use.
        3. Indemnities. You waive (ie. give up the right to) all claims against us under estoppel, and for all economic, emotional distress, dissapointment, inconvenience, annoyance or "mental distress" from using our services or goods we provide to you online or through our Systems. You further indeminfy us against all costs (especially transport, accomodation, legal and court fees) you incur in the course of a dispute with us.
      2. Specified Warranties. The only warranties & representations we make are our Package Rates and Print combinations (because of the broadcast nature of webpages) only after email confirmation.
      3. Obligations. Even if we have a right to do something, we do not have an obligation to exercise that right.
      4. Waivers. At our sole discretion, we may waive any part of this agreement. However, no matter the number of times we waive a requirement, that requirement WILL NEVER be automatically waived.

    3. Remedies
      1. Investigation. You acknowledge and consent to our right to investigate, or delegate the investigation of, any suspected or reported abuse of our Systems or breaches of this agreement. In such cases, investigation interests take priority over privacy interests.
      2. Breaches. Please report all perceived breaches of procedure or policy to webadmin@invertigo-studios.com for investigation. You can do this by forwarding us an unaltered copy of the offending material, with the subject line "abuse". Thank you.
      3. On unfair termination or No response. If you have been using our services lawfully and considerately yet cannot access our services or content, please email the webmaster. If you have not received a response from us after 4 working days, it may be due to our spam-filters. Please contact us by phone (+65 94789545) so we may temporarily add you to our email white-list.
      4. If Systems compromised. We will use reasonable efforts to try to inform you if we strongly believe your sensitive personal financial data or highly sensitive personal private information has been compromised.
      5. Damages. Although we disclaim liability, an arbitrator or competent court may decide that we must pay damages. If there was no malice or mischievousness on the part of Invertigo Studios' workforce, we limit the amount of direct and compensatory damages payable to SGD 1 per person: You further agree we will not pay out consequential, indirect/incidental, special, speculative, restitutionary or punitive damages or your legal costs.
      6. 3rd party enforcement. The Contracts (Rights of third parties) Act 2002 (Cap.53B) shall apply to this contract only if and to the extent it allows victims of a breach in clause B('Your responsibilities'), especially clauses 1 & 3, to take action against the wrong-doer. Should the previous sentence be enforceable, in actions not involving Ms Jacqueline Choo, the agreed and appropriate forum is the State Court of the victim.

    4. Dispute Resolution/Litigation
      1. Choice of law. The Republic of Singapore's law is the governing law of this contract.
      2. Breach Assessment. Ms Jacqueline Choo has complete discretion in determining the existence and extent of breaches to this agreement.
      3. Amicable Settlement. All parties have a duty to try to reach amicable settlement for disputes arising from this and all future Website Terms of Use agreements.
      4. Where to sue. If no amicable solution is reached within 2 calendar months from the date of dispute, you agree to submit to the exclusive jurisdiction of the Singapore Courts. You agree the court of first resort will be the Small Claims Tribunal as long as the claim amount is below its highest monetary ceiling.

Privacy Policy 4th July 2006 v 1.0.1

  1. Information collected. We collect traffic data in general, and personal data for bookings.
    1. For traffic data, we collect server interaction details such as resource requested, time of request, IP address, browser types and entry and exit pages. We generally regard such information as anonymous. The only way we could personally identify you is if we associated your name with your IP address. And since we generally don't have access to your ISPs traffic data or run kiddie-scripts to stalk your movement online, your privacy shouldn't be at risk from us :)
    2. For bookings, the kind of personal private information we collect is limited to identification, contact, location, and transactional information with 3rd party financial institutions. For portraiture, there are also personal interest questions targeted at the person making the reservations & the other persons to be photographed.
    3. For Registrations, the kind of personal private information we collect is limited to identification & contact information, the albums you wish to view and your relationship to our client (to expedite the approval process).
  2. Purpose of collection. We collect information from and about you to provide better service to you, to comply with legal requirements, as evidence of legal obligations, and for statistical or security purposes.
  3. Use. Your privacy is important to us.
    1. no spam. We will not intentionally send you unsolicited commercial mail.
    2. no unnecessary sharing. We will not sell or rent your "personal private information" to 3rd parties. If we share your personally identifiable information with 3rd parties it will most likely be to initiate, facilitate or comply with law enforcement/legal processes. In any other case, including a business acquisition, disclosure will only take place under an agreement that they abide by the privacy policy in force.
    3. storage & correction. We use reasonable measures to prevent unauthorised access to your data, such as encryption and access control lists. In general, we estimate storing relevant correspondance and other customer data for 8 years. This is for archival record-keeping and business accountability.
